srirama9 Posted July 7, 2015 Report Posted July 7, 2015 Hi, My H1B transfer is initiated (regular) 10 days back by new employer and is pending. My current visa is expiring in september. Can i apply for H1B extension with the current employer while my H1B transfer is pending ? Will i face any problems if ido so ? Thanks.
myvisakumar Posted July 9, 2015 Report Posted July 9, 2015 Hi, If his transfer gets approved first and then Extension. will it be a problem? If company B ask him to work with Receipt number. if company A revokes his extension. will it be a problem for Company B H1b transfer? I am also in the same boat. please advice.

Though one can join new employer based on receipt notice it will be wise to wait for approval. As long as employer B files a cap exempt H1B petition before revocation of petition by employer A it is fine. Even if not so employer B's I797 will come without I94 in which case one has to exit & enter with a valid visa & I797 to work.
