Question on -H1 B with expired petiton

Hello Friends,

 

Couple of years back, one of my friend applied for H1B of from India and his application was selected and got approval on his petition. After that he didn't travel with on that petition and even he did not go for visa stamping. Now he joined another company. 

 

Here my question is: Can he use the same H1B and find a new employer for sponsor and make use of it? Is this possible? 

 

Please let me know at the earliest.

Yes, he will be considered cap exempt. A new employer can file anytime.
