Visa Stamping After Passport renewal

Hi all

 

i have a Visa stamp Till Mid 2017, but my Passport expires in Oct 2016. i m thinking of applying for new passport well before the expiry (I m eligible 1 year before expiry). DO i have to go for stamping again?

 

FYI: 2 days ago i came in through POE (after a trip abroad) and the officer was not sure when i asked the same question. Is there any official website stating this situation i could print and take it with me for future travel for reference.

No you don't have to go for stamping again. When consulate issues you a new passport they will stamp your old passport "Passport Cancelled, Valid Visa not cancelled" which means you need to carry both the passport untill the visa expiry date.

Your visa is still valid but its important to check the expiry date on I94. If the expiry date on I94 matches that of visa, you are good. But if it matches the expiry date of Passport, then you need to travel outside the country and come back after you get your new passport so that you dont become out of status.

@TonyS which consulate are you referring to? Did you mean that consulate who issue my passport will mark "Passport Cancelled, Valid Visa not cancelled" in new passport ?? or is it done the next time i m in POE.

 

@wardoma Why is it important that i need to go outside and get new I-94. Just to clarify in the past i had my I94 expired but I received new I94 one along with my visa extension (797) attached. similarly i have one till 2017 on 797, is t that valid?
