ap_reddy Posted July 6, 2015 Report Share Posted July 6, 2015 Experts, Currently I'm in US and I was on H1B from Nov/2011. I'm out of US for 7 months till now. Mine and my spouse GC process was not started. Now I'm planning to go to H4 as I'm pregnent. My question is , If I do Change of status to H4( say for 2 years from now) , my 6 years period clock will stop for the period I'm on H4? Can I come back to H1B after 2 years? Attorney_21 Posted July 6, 2015 Report Share Posted July 6, 2015 In general, you're entitled to use the complete 6 years of H1B status that you are eligible for (and H4 time does not count toward the 6 years) - this means that you could switch to H4, and then back to H1B, if you still have part of your 6 years remaining....
