petition revoking

Hi

 

I had my h1b approved from 2008 till 2011, but din't even move to US even once. that means I din't use my h1batleast once.  If am an cap exempt, as it is more than 6 years would my petition be valid or will it have to be revoked.

Is there any way I can know if the petition is valid or not, coz I can't check with my earlier employer(petitioner).

2) If it has to be revoked is there something that my earlier employer(petitioner) has to do or can I start with a new employer.

That petition is no more valid. There is a possibility that you might be cap exempt. Talk to a good immigration attorney.

Revocation by previous employer has nothing to do with your ability to get cap-exempt petition.
