h.deshmukh Posted July 3, 2015 Report Posted July 3, 2015 I got laid off on H1B in nov 2014 and left the US in Jan 2015(within 45 days of the layoff). Now I have a new US employer who wants to transfer my H1B(8 months since Nov 2014) however I do not have the latest paystubs(my last paystubs are from Nov 2014) for the transfer. What are my options?
JoeF Posted July 4, 2015 Report Posted July 4, 2015 You were out of status from the time of layoff to the time you left.
jairichi Posted July 4, 2015 Report Posted July 4, 2015 Since you were outside US current pay stubs are not required.
livliv Posted July 4, 2015 Report Posted July 4, 2015 You don't need paystubs, since you are not in the US. The petition will be filed as consular notification and it will be cap-exempt (Assuming you have not used 6 years). You will then apply for Visa using that petition and travel to US to work for this employer.
