nirav284 Posted July 2, 2015 Report Posted July 2, 2015 Hello, My wife's OPT expired on May-2015. I have applied her H4 visa in February-2015 already but I am still waiting to get it approved. She needs to go to india. What are our options? 1) If she is in india and they approve her H4 here then I will send her that original H4 approval document and she will go for stamping. 2) What if still its not approved while she is in india, can she go for fresh new H4 application with this USA pending application? Please guide. Thanks.
jairichi Posted July 2, 2015 Report Posted July 2, 2015 The moment she exits US her COS to H4 petition is considered abandoned. She needs to apply for a H4 visa at US consulate.
livliv Posted July 2, 2015 Report Posted July 2, 2015 For getting H4 Visa she needs your H1 approval notice, which you must already have. Change to or exension of H4 status becomes irrelevant once you leave the US. So, just go and apply for H4 Visa at a consulate and forget about the change of status application.
