He didn't find me projects for the first few months(3) of this year. I cleared interviews and got verbal offers but he didnt agree to rate and dropped the ball there.The company is registered in VA. I was in Iowa and then in GA and now in TX. even now he is not paying me. His cycle always has a two month delay in the pay period. For the month of may, he invoices vendor in june and then pays you in july. He also doesnt pay unless the vendor pays him.Can anyone advice how to deal with multiple states?. Is he supposed to pay me while I am in bench?.Does what he say about the two month lag in pay cycle valid?. How do I approach and look for better employment opportunities.
JoeF Posted July 2, 2015 Report Posted July 2, 2015 File a complaint on WH4 with the DOL office in the state where the company is located. The law says that you need to get paid no less than monthly. And he has to pay you, even if the vendor hasn't paid him. If he can't do that, he has to file for bankruptcy. Delaying bankruptcy is a crime.
livliv Posted July 2, 2015 Report Posted July 2, 2015 Complain to DOL. They have to pay you as per LCA, as soon as you start your H1B status. There are laws on how frequently they must pay you and generally it cannot be longer than once a month. Also, find a real employer not a consulting company.
rahul412 Posted July 2, 2015 Report Posted July 2, 2015 1. File a complaint against that FRAUD employer for not paying you the promised salary. He has to pay you every month when you are on H1 2. Find another employer and file for H1 transfer with that complaint. This time find a real employer not a shady consulting firm.
