santhosheie Posted July 1, 2015 Report Posted July 1, 2015 Consider a non-immigrant was suddenly fired from a company and person's I797 and I94 is valid for another year. 1. Whether person is eligible to stay in US? 2. If so, how long the person can stay without an Employer?

Nothing prevents you from obtaining an H1B approval with a different employer and returning. I would suggest that you focus your energies on finding a new petitioner to file an H1B for you as you prepare for departure.
