ANANDSINDHU Posted June 30, 2015 Report Posted June 30, 2015 Hi, My H1-B Extension has been denied on 26th June 2015. However my I-94 is valid till 10th Oct 2015. I have applied for extension early. I got RFE in the month of May and now it got Denied. Please let me know my options: 1) Can I stay till my I-94 validity? As I stay would be legal till that date? 2) Meanwhile can I file for new Extension again? So that I can continue staying in the United States. Or do I need to leave the country immediately once I receive the Denial notice? Please let know.

I am still waiting for the Denial Notice to be received. Since my 797 is valid till Sep 30, 2015, can I stay till that date and apply for new extension meanwhile?
livliv Posted July 2, 2015 Report Posted July 2, 2015 1. Yes, unless denial is because of some reason related to your status. 2. Yes, but if they same employer files without addressing the reason for denial, it iwll be denied again.

You need to find another employer, not a consulting firm.
