srinath2003 Posted June 26, 2015 Report Posted June 26, 2015 Hi, I filed my EB2- India I-485 back in Nov 2011 and got my EAD in Dec 2011. All these years, i am doing renewal of my EAD. PD: July 23rd, 2007 Category: EB2-India I-485 filed Date: Nov 1st, 2011 1st EAD Received Date: Dec 23rd 2011 From last 2 years, USCIS always say "Case is in Background Check and cannot tell you any timeline at this time". I reached out to Senator, DHS and in-person inquiry but no luck. I even reached out to my company law firm who made an inquiry with USCIS and got the same message. To make sure whether my file is not missing with USCIS, I even opened FOIA as per my company law firm. I got a CD with all my documents from starting in PDF format which tells that my file is not missing. I am totally lost why they take 4+ years and still not able to complete background check. I sincerely request Murthy Law firm to provide me any guidance in this scenario. Is there anything your law firm can do and if so, I can reach out to your Office. Thanks, Sri
Attorney_21 Posted June 30, 2015 Report Posted June 30, 2015 Srinath2003: At this point, you might consider filing a "Mandamus" lawsuit in Federal District Court against the Department of Homeland Security, demanding adjudication of your long-pending I-485 (as you have the right to do). This can frequently secure a quick decision in cases which have been pending beyond normal processing times. (But remember, if there are any actual problems with your application, the result can be a quick denial by USCIS, so you need to provide your attorney an honest evaluation of any "skeletons in the closet" that could result in a negative decision before you pursue this strategy).
