parvinder18 Posted June 24, 2015 Report Posted June 24, 2015 Hi All,' My old H1b has been revoked today and my transfer is in process normal processing. i have receipt that my case has been received. my question is 1. Am i out of status now? as petition has been revoked and new one is not approved yet? 2. I have a employment gap while joining new employer of 4 days 22-April i left the job and 27-April 2015 i joined the new employer. During that time my petition was not revoked. but did those 3-4 days i was out of status? Thanks Parvinder
jairichi Posted June 25, 2015 Report Posted June 25, 2015 1. No, you are in valid status as a cap exempt H1B petition was timely filed. 2. No issue.
livliv Posted June 25, 2015 Report Posted June 25, 2015 If transfer receipt date is before your last day at work, you are fine. Otherwise you are out of status and transfer is likely to be approved without I-94.

And i received the receipt at 27-April-2015. Secondly i received my full and final pay check at 24-April-2015 (Friday). My LCA signed date was 20-April-2015 as my new employer posted the LCA 14 days before my joining with them. But i talked to my employer they are saying that its fine 2-3 days does not matter and till now i have also received couple of salary slips from their side. Kindly advise what to do in this case.
