kmr009 Posted July 15, 2011 Report Posted July 15, 2011 Folks, I have my earlier approved I-140 and I switched company recently, and the new company is sponsoring me green card. I know If my previous company revokes my I-140 before my new company applies according to the law I may loose the priority date. But I heard there are is ammendment to it. Can any one recently had similar situations ? tell me what is the trend now ? porting gets done or not ?
kmr009 Posted July 18, 2011 Author Report Posted July 18, 2011 Can anyone please answer ? Attorneys did you do similar kind of porting recently ? If so please respond. Thanks!
Joe.F Posted July 18, 2011 Report Posted July 18, 2011 If you have an approved I-140, even if it gets revoked, you keep the PD.
nihal0507 Posted July 20, 2011 Report Posted July 20, 2011 so even employer A revokes the I140 .we can use the PD if we have the original I140 approved copy or even a copy of it will also do ? 2)Also from employer A after getting I140 approval is there any time frame to stay with employer A like 3 months 6 months ?or we can go at any time after getting I140 approval
kmr009 Posted July 21, 2011 Author Report Posted July 21, 2011 1) Yes thats right. 2) there is no time period as such. if you have applied AOS (485) then 180 day rules applies.
