Question about arrest in i 539

Hello,

 

I am applying for my H1 extension along with my wife(H4). In filling up form i-539 i came across this question.

 

6. Have you or any person included in this application EVER been arrested or convicted of any criminal offense since last entering the U.S.?

 

now for this question, i was arrested once but the case was dismissed. And I have exited and reentered US after that incident. 

 

Should i declare yes or no? As it clearly says since last entering US, i am thinking no.

You have to list that.

Declare it as 'No', it's always better not to mention things that will fetch unnecessary validations in to picture.

 

I am not sure for what reason were you arrested and how serious was the issue, if it was a serious offence then they must be maintaining the history and can come up with a query later and then you can reply accordingly.
