Her current H1B will be terminated in Decmember 2015. After marriage she will be coming on H4 visa in January 2016. Can she convert from H4 to H1B at any time since she already had H1B which is terminated?Does she has to go through the lottery system or she can convert from H4 to H1B at any time? Thanks, Arun
jairichi Posted June 23, 2015 Report Posted June 23, 2015 An employer can file a cap exempt H1B petition anytime and she can work after approval. Ask her to get a copy of her H1B documents including I797.
