l12h1question Posted June 23, 2015 Report Posted June 23, 2015 I am currently in a L1 visa (valid till December 2015) and now I got my H1 visa CoS approved now for 2016 cap. My L1B company is asking me to go back to India by beginning of Aug. I am working to see if I can stay here taking a leave and stay here to bridge the gap. If that does not work out, can I resign from L1 company and stay in US for exact 8 weeks till start of Oct 1, or would that automatically make my current status invalid and hence need to go to India again.
jairichi Posted June 23, 2015 Report Posted June 23, 2015 You need to maintain status in US to stay which means to be paid your salary whether you are on leave or not. Otherwise you have to exit US.
