cristinasan Posted June 22, 2015 Report Posted June 22, 2015 Hello I am a teacher from Spain who has to renew a H1B Visa before July 28. When my district attorney was about to submit the renewal, he realized I had to request the waiver of the J1 I had three years ago. In my J1 visas I have in my passport, the two years rule does not apply. However, in one of the DS 2019, it say I do, but not in my visas and in only one DS2019 (I have two) Has anybody gone through this situation as well? I applied for the waiver and my application has been pending since May 8.
livliv Posted June 23, 2015 Report Posted June 23, 2015 If it is applicable to you as per the latest DS2019, you should get the waiver. Visa may have been issued under a different DS2019 form or category.

According to the school district attorney, he relied on the passport visas (I do not have the 2 years rule there). He never looked at the DS-2019. It has been in the renewal, 3 years later, that he has realized...I only have the 2 years rule in the 2nd DS2019 (I taught in NC with the J1 for 4 years)
