H1B transfer to another employer with Receipt number?

Hi All,

 

I have joined new employer A (Contract to hire with client(employer B)) with H1B transfer receipt number from Employer A and working in the client location and got two pay slips till now.

 

Employer A said they can't convert my H1B petition to premium due to temporary suspension by USICS till July 27.

 

Now client is asking me to join their company B now. Is it possible to initiate H1B transfer from employer A to employer B with H1B receipt number, valid I 94 and two pay slips. Please suggest.

Hi guys,

My situation is a bit similar. So I was working with a boutique consulting firm (employer A) and got an offer from a big four consulting firm (employer B). B filed the petition for the transfer of my H1B visa on June 3rd, 2015 based on my latest pay stubs from employer A and valid I94 expiring on June 19th, 2015. I got the receipt on June 10th confirming that that my petition has been received by USCIS.

The petition was filed for premium processing but because of the temporary suspension of the premium processing by the USCIS for all cap exempt cases, USCIS notified my attorney that my case would be adjudicated through the regular processing channel, at least till july 27 when the suspension is lifted.

Now my question is:

1. Will there be a problem if the previous employer A requests USCIS to revoke my existing H1B petition and the revolution is actually implemented before the transfer petition filed by employer A is approved?

2. Also,because my I94 expired on June 19, though the transfer petition was filed on June 3rd when my I94 and H1B visa status were still valid. So again, will this cause any issue to how the USCIS adjudicates my case.

Your help and advice would be greatly appreciate.

I am in some what similar situation

I was working with company X and I got offer from one of consultancy A, they started my H1 transfer in normal processing.

I got got H1 transfer receipt with USCIS date as 06/29/2015.

I left company X on July 10th and however I joined company A on Aug 3rd (3 weeks vacation).

 

My H1B is not yet transferred, Till now i can see only same status (Case Received)

Recently I got offer from company B they are willing to do H1B transfer but I am worried because my current H1 transfer with company A is not yet approved (I have receipt and 3 paychecks ) and my previous company X already revoked previous H1.

 

Can I do transfer with new company B? Is there any problem if i did?

I had worked for company A, On 10th March I have joined company B on H1B Receipt # - company B received RFE , they are going to reply in sometime.

Now I have another good offer from Company C which I don't want to miss ( my last H1B petition was approved till OCT- 2018, now they revoked it ) , Also have valid I-94 - no gap in employment/proper paychecks.

1) If company C file Bridge petition ,  Can I join them immediately on the basis of their receipt nr # ? ( this will be normal petition since there is no Premium after 3rd April )

2) If I have joined company C on transfer H1B receipt nr# , if company B petition withdraw or Revoked - will it impact company C petition ?

Your help/input  will be highly helpful to me !!

H1B transfer just before(3 months) of Visa expiry in U.S
Hi Team,

I am working in Company A working for company B(Client). Our client B offered me to join as a full time in Company B.I am interested in joining but I am having some confusion regarding my Visa.

My Visa is going to expire on 31-Aug-2017 and Petition expiring on 31-July-2017. But still, i have not applied for the extension. In this situation can I transfer Visa to Company B?
If yes please suggest when i can join Company B?
And please let me know when i need to resign Company A?
And if Visa transfer to Company B not completed before existing Visa expires what happened? Is it out of status? In this case, i need to leave the USA?
And how many days it will take for H1B Extension and H1B transfer?
