blnswamy Posted June 22, 2015 Report Posted June 22, 2015 Hello, I did my MS in US from Jan 2012 to May 2013. After graduation, i started working for a non profit organization (hospital). I was on my OPT from May 2013 to May 2014. I am eligible for STEM extension, but i never utilized it as my employer filed for my H1-B visa. Since I am a direct full time hire, and my organization is a non profit, my visa was cap exempt. i received my H1-B visa with a few days of application. I have been on a H1-B visa since May 2014. Now, i want to move on to another company(preferably a for profit company). How and when will i be able to get a new H1-B visa(a.k.a. transfer) to the future company. I am not sure if this has to be done during the next filing window in Apr 2016, or can it be applied by my future employer anytime. Please help as i am receiving very conflicting information from various sources. Thank you very much in advance.
JoeF Posted June 22, 2015 Report Posted June 22, 2015 Since you have not been counted for the quota, a for-profit company could only file an H1 for you next April for a start date of October.

jairichi Posted July 16, 2015 Report Posted July 16, 2015 You cannot work for a for profit company without going through cap. If you would like to move to a new employer then that employer has to non profit.
