ishanp Posted June 18, 2015 Report Posted June 18, 2015 H1B filed under the cap in 2014 has I-94 attached to it and it says that I-94 is valid till 08/20/2017 but few months ago I filed the H1B amendment because my work location got changed. 2 weeks ago I got the amendment approval without I-94 (I-797B). I have two questions: 1) can I continue working in US ? 2) is there any time duration within which I need to go to my home country and complete my H1B stamping ? Please Help. Thanks a lot in advance.

livliv Posted June 19, 2015 Report Posted June 19, 2015 You can certainly work. There is no I-94 because the amendment did not request a separate extension of status, that does not invalidate the previously issued I-94.

But my attorney said that I have a valid I-94 from the petition filed under the cap in 2014. So even I have a valid I-94 still I need to leave the country and get my stamping done immediately ?
saikiran111986 Posted July 8, 2017 Report Posted July 8, 2017 Hi Ishanp, I am in similar situation. My H1B Amendment got Approved(I-797B) without I-94. My Employer is asking me to go to India for Stamping. Could you please let me know, if you have left the country and got the stamping immediately. My most recent I-94 says i am valid to stay till 9/21/2018
