hivaidy Posted June 17, 2015 Report Posted June 17, 2015 All - My last H1B in-status date was Oct 2009. After that, I am in India until now. Though I understand H1B can be transferred to another employer (even if it is revoked), but I am seeing confusing, not consistent responses over the web on the possible last date by which I can do this transfer to a new employer. (I had been in US for 13 months from Oct 2008 to Oct 2009) Some of the responses in the web are saying that the possible last date by which I can transfer my H1B is within 6 years from the last in-status date which would be before Oct 2015 (and after that I should go for new H1B only) and some of the responses say that there is no such limit and the old H1B can be transferred to a new employer until you use up your 6-year quota of stay in US (which I have used only 13 months) Please help me with the correct answer as per the official rule. Thank you.

Hi Ponte, shall we transfer to another company eventhoug we donot have paystubs. means i stayed 16 months in USA, but my old employer ran payroll for few months only , for remaiining months he didnot ran payroll. i came to know before leaving. so now shall we transfer my old H1B to new employer without proper payroll? please suggest me and thank you for your quick reply.
