sreenu9f Posted June 17, 2015 Report Share Posted June 17, 2015 Hi, I converted from H1 to He other day and got stamped at chennai consulate in India. can i apply for H4 EAD from India as i will be here for next 2 months or should apply for H4 EAD only after entering US. while leaving US i was i applied a couple of weeks before leaving to India I 539 for cos from H1 to H4. jairichi Posted June 17, 2015 Report Share Posted June 17, 2015 A valid I94 is required to file for EAD. Since you do not have that now only after you enter US on H4 visa and get a new I94 you can file for EAD. Link to comment
rahul412 Posted June 17, 2015 Report Share Posted June 17, 2015 No you cannot, EAD is not a status that can be filed outside the US. And for EAD you need latest I94, so you have to be in US to file for EAD. Link to comment
