Reddy4 Posted June 16, 2015 Report Posted June 16, 2015 Dear experts, My friend has H1 sponsored by a new employer under premium processing (currently on hold until July 27). New employer wants my friend to join the company immediately and cannot wait until July 27th. How safe is it for him to join the new employer while his H1 pp is on hold for next few weeks? New employer is a reputed American organization and does not involve consulting layers. In a worst possible scenario, I see his new H1 may encounter RFE or denial. Then what are the options? Please shed some light on this.
jairichi Posted June 17, 2015 Report Posted June 17, 2015 Better to wait for approval. If denied your friend has to move to dependent status or exit US.
livliv Posted June 17, 2015 Report Posted June 17, 2015 It is safe to join. It is highly unlikely that a non-consulting H1 petition will be denied. If extension of status part of the petition is denied (possible if currently out of status), they can travel abroad and return.
