dindee Posted June 15, 2015 Report Posted June 15, 2015 Hi all, My previous company thought the H1B candidates are exempt of FICA taxes and didn't withhold FICA taxes for an year that I worked there. Now, I'm in some other company. When I received my paycheck in my current company that I realized my previous company didn't withhold FICA taxes. So, I contacted them about this. They are now asking me to write them a check for the amount calculated for one year of FICA taxes. I worked in that company from june 2014 to may 2015. In my W2, social security and medicare taxes are $0 withheld. I have already filed for 2014 taxes. Do I have to amend my taxes that I filed for 2014? Legally, could the company ask for the ex-employees to pay for the past year taxes? Isn't it company's responsibility to deduct taxes from the paychecks? Do I have to pay any penalties for not paying my FICA taxes last year? Also, when I was filing taxes, Turbotax software didn't find anything wrong with my W2 or didn't warn me of anything. Any insight would be greatly appreciated. Thanks!
livliv Posted June 16, 2015 Report Posted June 16, 2015 You may also be able to pay it directly to IRS / SSA. The employer will of course have to pay their share themselves, but that is not your concern. Consult a tax consultant / CPA. This is not an immigration matter.
