andiamo Posted June 15, 2015 Report Posted June 15, 2015 Hello people, I am currently on an H-1b that was approved for 1 year through change of status. Planning to file my extension sometime this month and need your advice on a couple of questions 1. Does the SOW/PO with the vendor affect the extension request. My client approves SOWs in 3 month increments. Is this duration sufficient enough for USCIS to approve my case 2. During the 2-3 month it takes for processing, will I be allowed to switch contracts, though I continue to remain with my current employer 3. After the H-1 extension is approved, are there any considerations to be aware of when it comes to changing contracts 4. Invite parents - While in the process of filing my extension, I am also planning to invite my parents for a short visit here and scheduling their B-2 visa interview. Would there be any problems in doing this or should I wait for my extension before inviting them here. Appreciate your advise on this matter.
jairichi Posted June 15, 2015 Report Posted June 15, 2015 1. You will get an RFE to provide an extended SOW/PO 2. Do you mean client? If yes then ammendment has to be made. 3. Refer 2. 4. Your status or extension has no relation to your parents' visitor visa.
rahul412 Posted June 15, 2015 Report Posted June 15, 2015 What exactly you mean by changing the contracts? If its mean changing clients, then you need H1 amendment whenever you change client.
andiamo Posted June 15, 2015 Author Report Posted June 15, 2015 Thanks guys. On #2, yes it is about changing client, But do I still need an amendment even if the new work location is within the same MSA and under 50 miles as on my current LCA The latest AAO rule changes below don't seem to require one. This is where I am a bit confused Thanks
