After a few years of working there (say 4), will I be able to use my on-the-job experience I received with company A when I apply for the employment-based GC as long as I get promotions along the way? JoeF Posted June 15, 2015 Report Posted June 15, 2015 You can not use experience with the company for the GC. The reason is that an outside candidate would not have that experience, so you would have an unfair advantage.

I have learned that very soon, I may actually have the opportunity of working for another company B doing similar (but not exact) work for 2 years before I return to the company A mentioned above. If I elect this route, even if my job title at company B would be the same as what it would be at company A during time of GC application with company A, would I be eligible to use the experience from the other company B on the GC application? Or in this case would it still have to be extensively demonstrated that the job at company B was more than 50 % different than that at company A? Greatly appreciate it! Vara
JoeF Posted June 16, 2015 Report Posted June 16, 2015 I think at the very least you are likely to get an RFE, because this is too obvious an attempt at a work around the rules.
