begooddogood Posted June 9, 2015 Report Posted June 9, 2015 My H1b Visa stamping page has 6/11/2015 as expiry date. I am in my 6th year of my H1b and have almost 11 months remaining to complete my 6th year in h1b. Currently working for a comp A where H1b extension is filed and under regular processing by Feb of 2015 and got RFE, no response provided by my attorney yet. Regular processing was chosen as my employer was wiling to process my i140 in premium. Labor process was underway when my H1b extension was filed.I have time till July 17th to respond to my h1b extension RFE. In the mean time my i140 got approved. Now I have an offer from Company B and they have filed my h1b extension using approved i140 from comp A on 6/3/2015 in regualr processing as premium processing is suspended temporarily. How long would it take to get the receipt number under regular processing? This would help me in planning my notice to the current employer. I will have to start working for comp B as I cannot wait for 4 months for the regular processing to adjucated.
jairichi Posted June 10, 2015 Report Posted June 10, 2015 7 to 10 days to get receipt notice. It might take a bit longer due to H4 EAD processing now. But, do not resign from current employer before approval of H1B petition with new employer. If current employer revokes I-140 before H1B petition approval with new employer you will get only 11 months approval. Also, if current employer revokes H1B petition and new employer's petition is denied you will have to exit US.

But the reality is, I dont think the offer will hold good for such a long time. Also, comp B is a full time position and not a consulting company. Its a financial based company and expecting an approval. When I joined this comp A last year I took the same risk by resigning the company X were I use to work for close to 8 years. Got RFE in transfer as Comp A was very small comp with only 9 employees. So I feel kind of confident in resigning comp A and joining comp B(Wall St) with receipt notice. And also I hope my current emp will not revoke the approved i140. With all the respect, Thanks jairichi for your response. Feel free to comment. Is it true? Or, are they just making up a big number so that I wont disturb again for some more time? Any thoughts...

My Attorney said me it would take any where between 1-3 weeks given that H4 EAD application processing started from May 26th . I could see in some other forums where they are receiving receipt numbers in 10 to 19 days .

Thanks Akshat It is better to be safe and that is the reason why you get a standard reply from me to wait for H1B petition approval. Wait for at least receipt notice. A GC can be filed anytime as it is for future employment and there is no requirement that one has to be on H1B.

I haven't got any update yet . Hoping to get sometime around next week . I think it has been already 15 days for begood . Attorneys are saying these days it is taking up to 3 weeks because of large volume of applications received by H4 EAD . Thanks
