J-1 exceptional Hardship waiver

Greetings All ,

I'm an alien physician in my last month of fellowship , on a J-1 visa , I applied for J-1 waiver based on exceptional hardship , 3 U.S. Born kids , wife is NOT American nor LPR , application received by USCIS on March 11 , on June 1st status updates to "we requested another non-USCIS advisory opinion for your Form I612, APPLICATION TO WAIVE FOREIGN RESIDENCE REQUIREMENTS" , what's is this non USCIS advisory opinion ? Is it DOS , I check DOS online case status and still says no information! Could this advisory opinion be from other than USCIS? I'm trying to wrap my head around this process ,,,,

It means that the USCIS likely found a case for exceptional hardship and has sent form I-612/I-613 to the department of state. 

 

Did you send form DS-3035 and all the necessary documents from the DOS and obtained a case number yet? This may take upto 2 weeks to update. But if you did that in march, it should have updated by now.

as of 6/23/15 DOS sent my lawyer a request for fees and form 3035, my lawyer office sent the fees and the 3035 on July first , So far DOS case status says pending and Fees /3035 FORM REQUESTED ,,,,

Once DOS has all the necessary documents, it will take anywhere from couple of weeks to 4 months for the DOS to respond. For me, it took roughly 9 weeks before the recommendation turned favorable. Good luck.
