boomjosh2007 Posted June 9, 2015 Report Posted June 9, 2015 Hi, On March 24th 2015 my employer applied for H1B extension after 6 years based on my I-140 from my previous employer. On May 19th USCIS came up with a notification that it will not accept any premium processing applications starting May 26 till July 27. My employer applied for premium processing and the case status was updated on May 27 stating, We received your request for premium-processing of your Form I-129, Petition for a Nonimmigrant Worker, and mailed you a receipt notice. Today morning (June 9th 2015) the status was updated to, Fee Will Be Refunded On June 9, 2015, we made the decision to refund the fee for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC15118XXXXX. We will mail your refund to the address you gave us. This refund does not affect the processing or location of your case. You should receive your refund within 30 days. If you move, go to www.uscis.gov/addresschange to give us your new mailing address. What does this status mean? I am confused not sure if it means that the premium processing was not accepted or the 15 days limit is over so they are returning the fees? The wording of the status is pretty confusing too, it says refund for Form I-129, not sure if it means the premium processing fee or the fee for the whole of the I-129. Any help on this will be highly appreciated. Thanks
rahul412 Posted June 9, 2015 Report Posted June 9, 2015 They are refunding your premium process fee. So your case is not under premium process now.
jairichi Posted June 9, 2015 Report Posted June 9, 2015 Your employer will receive a refund of PP fee as your petition would have been acknowledged by USCIS on or after 26th May 2015.
boomjosh2007 Posted June 9, 2015 Author Report Posted June 9, 2015 @rahul412 and @jairichi thanks for your inputs. My original application was filed under regular processing on March 24. Any idea when my petition will get approved? Current USCIS processing times for California center for H1B extension cases is 2 months, will the H4 EAD affect these timelines?
jairichi Posted June 10, 2015 Report Posted June 10, 2015 @rahul412 and @jairichi thanks for your inputs. My original application was filed under regular processing on March 24. Any idea when my petition will get approved? Current USCIS processing times for California center for H1B extension cases is 2 months, will the H4 EAD affect these timelines? 3 to 4 months. Currently taking longer than that.
rahul412 Posted June 10, 2015 Report Posted June 10, 2015 I guess H4 EAD will effect these timelines. Stopping premium processing was the clear indication.
boomjosh2007 Posted June 10, 2015 Author Report Posted June 10, 2015 Thanks for your help guys. With no other option I will have to wait.
