BorisIvanov Posted June 9, 2015 Report Posted June 9, 2015 My friend is a post doc researcher in a mid-west US university and is on an H1-B work permit. She had done her BS/MS degrees in her home country and then did her PhD in that US university where she's now working as a post doc fellow in the science field. My question is can she apply for her first H1B visa from any of the consulate offices in Canada (Toronto etc) or does she have to go back to home country in order to apply for this? Thanks.

The fact that my friend may likely get " 221g due to the nature of research" is a clear sign of the need for immigration reform in this country. I am not blaming the consulate/embassy officers making the decisions because they are trained to follow guidelines and it is those guidelines that are nonsensical .... sigh
JoeF Posted June 10, 2015 Report Posted June 10, 2015 You don't say what her field of study is. In some fields it probably is fine, but certain fields have additional checks due to possible security issues (imagine Chemistry and explosives and certain countries of origin like in the Middle East...)

If one is doing a postdoc research in Economics or Mathematics then there might not be any trouble.
