sivakumar777 Posted June 9, 2015 Report Posted June 9, 2015 Hi guys I have entered into USA with H4 visa stamping ,after that I converted into H1b visa and working till last January after tht due to some personal problems I am not working so I dont have recent paysubs. So now I want to convert from H1b to H4 visa ,and my previous H4 visa is still valid till July 2015. So my question is now I would like to go to India and come back on my previous approved H4 visa stamping before it expires so that my status will be on H4 . Is it possible to do that did anyone experienced this kind of situation . Need your suggestions.
rahul412 Posted June 9, 2015 Report Posted June 9, 2015 Yes, you can. But you cannot get your H1 in future if you want to work, because of no pay stubs. On H1 you need to get paid every month, if you are on H1 and not getting paid then you will be considered out of status.
satya2k1 Posted June 10, 2015 Report Posted June 10, 2015 yes, you can travel and enter with old valid H4 visa. Keep in mind, your H4 status (I94) will be valid till the H4 visa validity date..i.e, July 2015, unless you have your spouse H1B extension approval (I-797).
