Visa9
Hi Friends, I am on H1B Visa and my spouse is on H4. My H1 extension was applied on June 2nd 2015 in normal processing mode.My attorney forgot to apply my spouse's extension.Attorney will apply my spouse extension on 15th of June 2015. Now my question is does USCIS process both the applications at a time or separately? I heard that processing application separately takes 6 to 8 months for H4's. Is that correct? If i want my application (Primary) to be processed in Premium ,do they consider my spouse's application in Premium as well? Please let me know. Link to comment
jairichi
1. Separately. 2. 3 to 4 months. 3. No PP for H4 EOS as it was filed separately. Link to comment

Visa9
Hi Jairichi, can my spouse go outside of USA when H4 extension is in pending state? Thanks in Advance Link to comment
satya2k1
h1visa9, Here is my take on your situation. Ask your employer to process your H1B in premium processing, get H1B approval, and then have your spouse travel outside USA and get H4 visa stamp and enter with new I94-EAD. My estimate for this whole procedure might be less than 3 months. Or you can take a chance by sending your spouse H4 application with your H1 premium precessing application. If both applications (H1 and H4) were sent at the same time, then you would have got both approvals at same time. Bad luck, your attorney messed up... In my experience.. Attorneys or their assistants make simple and small errors which makes a huge impact on our lives. It's sad but that's reality... Link to comment
