vennkattt Posted June 8, 2015 Report Posted June 8, 2015 Hi all, My wife is planning to convert from H1 to H4. 1. if she apply for COS, can she work until her COS is approved? 2. Since the COS takes too long, Can she go to Canada and get H4 stamped on her passport? 3. If her employer lay off before COS is approved, can she stay in US or she has to go out and get her visa stamped? if she go out what happens to her COS? Any help is greatly appreciated. Thanks in advance.
jairichi Posted June 8, 2015 Report Posted June 8, 2015 1. Yes. 2. Yes. 3. She can stay in US till a decision is made on her COS to H4 petition. If she exits before a decision is made then her COS is considered abandoned. She need to apply for a H4 visa and enter US.
