ioptimist Posted June 8, 2015 Report Posted June 8, 2015 Hi, Is there anyone who applied for H1B transfer in Premium processing with/without an extension of stay and got receipt number after May 26 ?? There is no clarity on this, so checking to see if some one even tried and got reciept or else got Premium processing money refunded by USCIS due to suspension. My H1B is valid till Sep'2017 and applying for H1B transfer to a new employer. appreciate your quick response.

kkinusa Posted June 9, 2015 Report Posted June 9, 2015 On May 26, 2015, USCIS temporarily suspended premium processing for H-1B petitions filed requesting an extension of stay until July 27, 2015. Form I-907, Request for Premium Processing Service, for a Form I-129, Petition for a Nonimmigrant Worker, requesting an extension of stay for an H-1B nonimmigrant will not be accepted during this time. This temporary suspension allows USCIS to implement the Employment Authorization for Certain H-4 Spouses final rule in a timely manner and adjudicate applications for employment authorization filed by H-4 nonimmigrants under the new regulations. well, ask the lawyer and see if they will accept. nothing wrong in trying

However I need to travel abroad after 2-3 weeks and concerned about not gettign receipt before that. And If I do and resign with my current employer, then not sure whether I will be allowed to enter US while application is still pending... Any insights on how to deal with this situation is highly appreciated.

confessions Posted June 12, 2015 Report Posted June 12, 2015 I got two opportunities in last month. My H1B transfer is filed in premium processing by EmployerA on 5/29/2015 and it got approved on 6/9/2015 and EmployerB filed the transfer in premium processing on 6/9 and I have got the receipt number. Premium processing is suspended only for 'Extension of stay' and 'Change of Employer' can still be filed in this mode. Hope this helps...
