nirupama.parmar@gmail.com Posted June 6, 2015 Report Posted June 6, 2015 Hi, My F1-OPT expires on 06/13/2015 and my I-94 has expiry as "Duration of status". I have applied for H4 and H4-EAD on 27th May, 2015. Still havn't received receipt yet. Will it be out of status issue ? if I receive receipt after 06/13/2015. Do I have to leave USA. I have surgery coming up in july. Could you please guide me ? Thanks, Niru
livliv Posted June 7, 2015 Report Posted June 7, 2015 On F1 status, you have a 30 days period after OPT expires. As long as COS receipt date is before this 30 days, you will be fine.
JoeF Posted June 7, 2015 Report Posted June 7, 2015 Once you have the H4 receipt notice, you are legal. You have to stop working when the OPT expires, and you can only start working again when the H4-EAD is approved.
jairichi Posted June 7, 2015 Report Posted June 7, 2015 Once a receipt notice is generated you are considered under legal stay till a decision is taken by USCIS.
rahul412 Posted June 7, 2015 Report Posted June 7, 2015 You have applied for H4 before your F1OPT expiration date, so you are safe.
shekar11# Posted June 8, 2015 Report Posted June 8, 2015 Nope you are good. You have applied before your OPT expiry date. So you are good. Can you please let us know the outcome, because looks like you did concurrent filing and I want to know how it works out.
nirupama.parmar@gmail.com Posted June 8, 2015 Author Report Posted June 8, 2015 Thanks everyone. I applied concurrenly for H4 and H4-EAD. The receipt notice date is 06/01/2015 for both. My OPT expires on 06/13/2015. I am going to stop working on 06/12/2015. I have notified my DSO in the school also. As I received repeipt before my expiry of OPT, I should be fine right ? Please advise me. Thanks
sandybhai Posted June 18, 2015 Report Posted June 18, 2015 Hi Kayra Please keep us posted on the outcome of your applications as we are also in the same boat where we want to change from F1 OPT to H4 EAD and wanted to see how much time it takes and would you receive approvals for the both the applications at the same time.
