Agreement of work after green card

Hello Experts,

 

I have a very basic question about the application process of green card  and the processing times after I-140 approval. This is because i wanted to specify the detailed process to my HR which will in return help me. 

 

The major reason for asking this is...recently my I-140 was approved and i asked my employer to provide me a copy of I-140. When i asked the copy, my employer said that they can provide it to me but they wanted me to sign an agreement which mentions that i should work for the company after green card approval for XX number of years. If i break the agreement, then they are asking me to repay the expenses that were spent on green card.

 

The problem here is not about getting my I-140 copy but the agreement that my employer asked me to sign. My Priority date is March 2014(INDIA EB2)...As per my guess, the green card might take atleast 4-5 more years(just a guess) and i wanted to clearly explain to the HR that they are asking me to sign on agreement to work for almost more than 5 years. Is this something usual? what can i do on this? Any suggestions?

march 2014 will at least take an other 10 years with the volume of people applying for Green card. dont sign such an agreement as you will be stuck with him for ever .

Can you or anyone else explain the steps that are involved after 1-140 approval?

1. Legally, thay cannot ask you to repay them for PERM/ labor costs. You can pay for I-140 and I-485.

2. your date will not be current for many years to come so you should get a copy of the I-140 from them. This will allow you to change job if you need to do it. They can only ask for I-140 expenses which is @ $1000. I do not think they will chase you for such small amount if you leave. They must be really cheap people to ask for ~ $ 1000.

3. They do not want to give you I-140 copy as they may know that you can use it to change jobs.

4. Aggreements are covered by labor law so you need to check if such aggreement is valid in the state you live.
