sjpraveena Posted June 5, 2015 Report Posted June 5, 2015 Hi, I am L1B VISA holder and I am here in US from May 2012. I was given I-94 till May 2015 and I had not gone out of US till date. In the month of April,my company applied for my L1B extension premium and it went for a RFE and I was given time till June 27th to respond on the RFE. The company had sent response to USCIS on June 4th and I could see the status in USCIS website updated as RFE response received and they will respond to that by August 3rd. By any chance if my RFE is not accepted and my extension is denied,I know I can not stay in US and it is illegal. My questions are... 1.Should I leave the country the same day I receive the extension denial or will I be given any grace time (1 or 2 weeks)? 2.Can the L2 be initiated for me from here itself (as my husband is in L1b and his extenion is approved till June 2017) or should leave US and get back to my country and L2 can be initiated from there only? Please let me know.
jairichi Posted June 7, 2015 Report Posted June 7, 2015 1. A week is fine. 2. Once you get a denial you could try to apply for a COS to L2.

If filed immediately it can be done by filing a COS petition (I539) along with supporting documents.
