I got a new job and they applied for my h1b and I was selected. My h1b was approved starting from oct 2015. Unfortunately, I was notified that my job will end in ten days(they will revoke my h1b in one month). I want to check what are the options available to me. I want to check whether I can transfer my h1b to new company. Am I eligible for OPT extension if my h1 was revoked before I got a new job.
jairichi Posted June 3, 2015 Report Posted June 3, 2015 Looks like your H1B got approved as COS. You will be cap exempt only if H1B employer revokes your H1B petition after Oct 1st. Only after Oct 1st you can ask new employer to file a transfer. If you exit and enter US with a valid F1 visa, OPT EAD card and supporting documents after on or Oct 1st you can maintain your OPT.
JoeF Posted June 3, 2015 Report Posted June 3, 2015 The H1 can NOT be transferred before Oct. 1, and you will not be considered counted for the quota once it is revoked.
