H1 transfer in progress with RFE filed by two companies.

Hi,

 

I have recently resigned from my previous company A(Valid H1 and Valid I 94) and Company B filed Premium Processing for me.

I started working for Company B with receipt number but my H1 went into RFE.

I then got a good offer from Company C. I explained my situation to them and they said I should not have any problem in my H1 transfer to Company C.

I provide them all H1 related documents of Company A and the receipt number of Company B.

Company C filed my transfer in Premium, and I started working with Company C with the receipt number. But unfortunately the transfer process went into RFE with Company C because of RFE with Company B.

My receipt with Company C was received before I quit Company B.

Company B had informed me that they would file for withdrawl of my H1 petition as I am no longer with them.

 

Can you please help me understand, if I was out of status at any point of time. I had my pay stubs running without any gap.

 

I also need to understand what could be the worst case.

You were not out of status. If employer B's petition is denied or withdrawn you will most likely get an approval with employer C without an I94. In that case you need to exit and enter US with a valid H1B visa, I797 and supporting documents to work for employer C.
