pradeepsahoo85 Posted June 2, 2015 Report Share Posted June 2, 2015 Hi My employer filed for my H1B extension thru the Premium processing but today I received RFE on my petetion and USCIS ask more document to prove "Right To Control". Below are the list of document they are looking for. 1. Vendor Letter 2. Client Letter 3. SOW between client and Vendor. My employer already told me that they have submitted the PO for the project. I work in EVC model. Out of the above 3, Vendor has agreed to provide me the vendor letter but they are hesitating to provide the SOW as it is confidential to the vendor. Secondly client is also reluctant to issue me a letter as they are telling it is against their policy. Now I am very confused about my petition what will happen to it now. jairichi Posted June 2, 2015 Report Share Posted June 2, 2015 In the model you work it is tough to say that your employer controls your work as it is actually by client. Let your attorney handle this RFE. Link to comment
trt221gnov14 Posted June 3, 2015 Report Share Posted June 3, 2015 I got approval by providing only the client letter in the past. Try if you can get the vendor letter with client details like you are working at xyz location as you mentioned in petition. This is just my opinion. Link to comment
pradeepsahoo85 Posted July 23, 2015 Author Report Share Posted July 23, 2015 Thanks Folks for your suggestions. My H1B status has been updated now and it is approved for 3 Years. After receiving my RFE about "Right To Control", I worked with vendor to get a letter which states I am all time under control of my employer (H1B Petitioner) having hiring and firing capabilitiy. Also they mentioned the work location as mentioned in the LCA. They did not put any end date on the letter. Apart from the vendor letter I was able to get the SOW between the client and vendor, they faxed the SOW directly to my employer. In addition to these 2 documents I provided my client batch and screen shot of my Outlook contact card. These documents fetch me a 3yr approval. Link to comment
