chikkubhai Posted June 1, 2015 Report Posted June 1, 2015 First the huge RFE:Maintenance of Status: 1. school catalog, syllabus, requirements, hours, course structure, thesis requirements, length of study 2. DSO day by day on campus hours, credits earned, attendance record 3. DSO full course load for graduate students at school 4. evidence to establish proposed employment is directly related to major of study 5. Bachelor's degree from IndiaProof of Residence: 1. all addresses 2. bank statements, bills, agreements, mail correspondence from school 3. proof of current address and telephone number I am pregnant and due any time now. Regarding the letter "documentary evidence to establish proposed employment is directly related to your major of Study". I am curious Is USCIS is asking for a job offer letter? because students are not supposed to start working (or even look for work) until the OPT arrives, isn't it?We originally thought about including our Doctor's letter that she is due anytime and won't be looking for work for a month but realized we requested an OPT start date of end of this May month which could be confusing to USCIS.I want to take Murthy Forum opinions based on how USCIS perceived different responses. Did any of you guys include offer letter or told USCIS that you did not have one yet? Which one worked?Lastly, for all such complex RFEs, did USCIS accept all provided documentation without asking further questions and approved OPT? Was there ever a problem? What happens in the worst case if the OPT is denied? Can you still apply for H-4/EAD when OPT has an RFE? My university is helping me gather some documents, can Murthy Attorney's also help in this matter?
jairichi Posted June 2, 2015 Report Posted June 2, 2015 A student can look for OPT opportunities before graduation. Nothing wrong with that. Only thing is they cannot start to work. Explain your situation in detail. This RFE is not common.
pontevecchio Posted June 2, 2015 Report Posted June 2, 2015 It possibly depends on the Name of the College. By all means give the firm of Murthy a call.
JoeF Posted June 2, 2015 Report Posted June 2, 2015 Care to tell us which university this is? Such stuff would not be required from attendees of real, known universities.
livliv Posted June 3, 2015 Report Posted June 3, 2015 First the huge RFE: Maintenance of Status: 1. school catalog, syllabus, requirements, hours, course structure, thesis requirements, length of study - School website or DSO 2. DSO day by day on campus hours, credits earned, attendance record - School DSO can provide 3. DSO full course load for graduate students at school - School DSO can provide 4. evidence to establish proposed employment is directly related to major of study - A written statement explaining that she is searching for a job and she fully intends to accept employment in her field of study only 5. Bachelor's degree from India Proof of Residence: 1. all addresses - She should have reported all her addresses to the school DSO. This is mainly to check that she was within commuting distance of the school 2. bank statements, bills, agreements, mail correspondence from school 3. proof of current address and telephone number I am pregnant and due any time now. Regarding the letter "documentary evidence to establish proposed employment is directly related to your major of Study". What happens in the worst case if the OPT is denied? - She will have 30 days to apply for change status Can you still apply for H-4/EAD when OPT has an RFE? - Yes. My university is helping me gather some documents, can Murthy Attorney's also help in this matter? - Call them See above
chikkubhai Posted August 11, 2015 Author Report Posted August 11, 2015 Care to tell us which university this is? Such stuff would not be required from attendees of real, known universities. Had baby and recovering from it. This is a real university in Fremont, CA (don't want to share name) and ended up submitting a "thesis literally" with a full history of class presence, living history and letter from GYN doc saying I won't be able to start work until end of Aug. Also started looking for jobs instead of waiting. It is Aug already and have not heard back from USCIS since mid June and OPT applied in May. What is the max/average wait time? If USCIS does not respond by end of AUG, can we still apply for an H-4 with a premium? If USCIS rejects OPT, can we still apply for an H-4 with "premium processing", does this need to travel out of country? Trying to get all options as I need to support baby until we get passport :(.

Let me guess: Northwestern? While they are accredited, they aren't all that good. The ratio of real faculty vs. adjunct faculty is a good indicator for that. This institution has more adjunct faculty, i.e., people who work elsewhere and just teach in their spare time, than fulltime faculty.
