pavan8012997 Posted May 31, 2015 Report Posted May 31, 2015 I have my H1b period from OCT 2007 to SEP 2010. I have worked in USA till OCT 2009 and came to India on NOV 2009 due to personal reasons. I have been working in india from NOV 2009 till date. Now i am planning to come to USA by using my old H1b which i have not used completely. I would like to know the period of recapture, I mean till what time i can apply for my re-capture. Will the recapture period be counted from the date i have left USA or the date from which H1b got expired. Please confirm on that.
jairichi Posted June 1, 2015 Report Posted June 1, 2015 An employer can file a cap exempt H1B petition anytime and you are eligible for 6 years - time spent in US on H1B.
