Green Card Dream!

Hi,

I am a B.Sc Maths graduate from Madras University, India (Year 2004) and having an IT experience of 8+ Years till now. I got H1B Visa approved in Sep 2014 and currently awaiting my Employer approval to migrate to US most likely to be in a couple of months.

I am very much interested to become a Green Card holder as my project is very long term project & if I am able to prove my hardwork, I have a prospective 5 Years ahead of me in this project. I am hoping to apply for Green Card after this, but based on your previous responses, I understand that I am not likely to get a Green Card with just a 3-year B.Sc Maths degree.

1. Dumb question: Is it possible to get GC still with just a B.Sc Maths degree and 10+ Years of IT experience on any Category?

2. My designation is “Associate Operations Manager” which is equivalent to Senior Engineer. Will it help to gain GC if I become a Manager in 4 years in this project after migrating to US?

3. Next Option is pursuing a Masters Degree at US. Please mention few Masters degree (preferably Online) & some Universities which are easier to complete.

4. Please advise me on what steps I have to take from now on to be eligible for a Green Card. Also specify the category I will fit in without much hassles EB1 or EB2 or EB3.

Kindly help with a detailed answer which includes as much elaborations as possible. Please help.

P.S: I had “Programming Language ‘C’ with Mathematical” as a Subject during my Final Year of B.Sc Maths graduation.

First let me start with establishing, Green Card is not a right, it is a privilege which will depend on your employer being willing to sponsor one for you (assuming you are looking to get an employment based GC). So having an aspiration to get one could be, but to realize it, your employer should be willing to sponsor one for you. You DO NOT apply for Green Card, it is applied for you by the employer if they so choose.

A1: Minimum requirements for EB based green card is Bachelors Degree + relevant experience, so unless your B.Sc qualifies as Bachelors degree in US, you do not qualify for EB based GC. Get an evaluation of your education qualifications done to find US equivalency.

A2: To qualify for an International Manager (EB1), you need to be a Manager for over 1 1/2 yrs prior to transfer to US.

A3: Such short cuts (online degree) DO NOT work, you need Masters from an Accredited University, and again NO such thing as easy to complete, if you study and prepared for the hard work needed to go through a Masters Degree program then you will complete.

A4: EB Category is decided on the job requirements, not on your qualifications. e.g. If you are working/applying for a job that requires only a Bachelors degree and you have a Ph.D, the EB category still would be EB3. So along with upgrading your qualifications you need to find a job with advance requirements as well, to have GC filed in an upgraded EB category.

Again, these answers are based on my understanding of the US EB immigration system, please consult with a qualified immigration attorney for specific queries. Also reading through a plethora of information available on this forum would help you in the long run, one thing is for sure there are no short cuts in EB GC process, so be prepared for a long haul.

Good Luck with your GC dream.

Good Luck with your GC dream.

Half of USA is hell bent on path to citizenship for illegals and you are preaching somebody well qualified about right of green card..

EB1C is a shortcut to GC, if you keep up with real world events..

If one really believes that job duties dictate EB category...no software tester should be qualified for Eb2..half of them have 3 yr bachelor's degrees..
