7th year extension eligibility

Will I be eligible for 7th year extension with New Employer & PERM approved with Old employer, (Max out date: Jan 2016, PERM filed : Nov 2014, PERM approved: May 2015)

 

I have recently moved to company B from company A (Company B acquired Company A, we were re-badged to Company B). My old employer (Company A) filed my PERM in Nov 2014 (365 days before my max out date Jan 2016) and it got approved in May 2015.

 

New employer (Company B) has initiated the H1 transfer in Apr 2015 and  GC process in May 2015. 

 

1) Will I be eligible to get the 7th year extension with the new employer based on approved PERM   from old employer after Jan 2016 (max out date: including all days out side US) ?

2) Someone mentioned that, 7th year extension is only possible if the PERM is pending (and applied before 365 days) but not if it is approved ?

 

Please clarify ?

Approved PERM does not give you an extension. Approved I-140 does. Also, PERM or I-140 pending for 365 days gets you an extension.
