adesai79 Posted May 25, 2015 Report Posted May 25, 2015 I have an approved I-140 from my previous employer. In order to file for H4-EAD for my spouse, I need a copy of that I-140. However, I cannot seem to find a copy of that I-140. I think I might have accidentally shredded it few months back when cleaning out my other documents. What are the options for me to get a copy of that I-140 now? How will that impact my H4-EAD? Gong to previous employer and asking for that document might not be an option, since I left that job more than 4 years back. Please advise.
jairichi Posted May 26, 2015 Report Posted May 26, 2015 Ask your previous employer for a copy (give a try) or file a FOIA with USCIS.
rahul412 Posted May 26, 2015 Report Posted May 26, 2015 I think you need to have copy of I140 for EAD application.
livliv Posted May 27, 2015 Report Posted May 27, 2015 They may accept receipt number if you have it, but that is up to them. Does your current employer or their attorney have a copy? They must have filed their H1 using that.
adesai79 Posted May 28, 2015 Author Report Posted May 28, 2015 Thanks all. I am checking with my current employer, but just looking for what other options I have, in case they don't have the copy. I will also speak with an attorney to check for possible options.
obscurenessmoon Posted May 29, 2015 Report Posted May 29, 2015 FOIA is an option. Just request for I140 document instead of all documents for faster processing. Employers may not share 140 as it's their property.
