sona85 Posted May 21, 2015 Report Posted May 21, 2015 Hello folks, I need an expert advise regarding filing for my H4 EAD. My husband is planning to switch job. We are filing h4 ead based on his current h1 and my current h4. While we file I765 on 26 May, his new firm is also going to file for h1 transfer and h4 extension in coming 10 days. and then his current employer will have to notify USCIS to revoke the I797 h1 petition that is cited in the proof of documents of my h4 ead application. His current employer will not revoke I140 so it will remain valid. Will the h1 transfer and h4 extension by his new employer will invalidate my h4 EAD application? or Is there any way that I can file I765 in this scenario on 26 May? Any help will be appreciated.

I called USCIS, they said that if your husband's h1 get transferred to new employer then you will need to file H4Ead again because your Ead depends on his h1. I am totally confused what to do. Could anyone please tell me in detail how to proceed this case.
