Ex-wife name in Passport. H4 visa for new wife. Help!!!

Need your expert opinion and help on this.

 

My current situation -

H1 approved till 2018. Amendment to new client is in progress in Premium mode.

Currently in India.

2nd Marriage is in next 2 weeks. Will recieve marriage certificate a week after that.

First wife's name is still on my passport.

Didn't got enough time to delete name of my earlier wife from my passport, as I got the divorce decree bit late. And secondly since my H1B processing was in progress, hence did NOT want to change the passport.

 

Now, once my amendment procedure is completed (in approx 1.5 months), I will have to travel to USA. Should I delete name of my first wife, till the time am in India (Passport number will change) OR should I do this deletion procedure once am in USA. Because, I believe my wife will not be able to travel with me due to name of my earlier wife on passport.

 

Secondly, am not sure how many days it will take to do this name change procedure in USA. The problem with doing this passport change in India is, due to ANY reason if my passport gets delayed, my employer will not be happy and situation might become grim.

 

Is there any way, still I can file H4 for my wife inspite of this passport ex-spouse name problem?

 

Is there any solution to my problem?

Should not be an issue to bring your wife along with you. Carry all court related documents for divorce and recent marriage certificate. After entering US you can get it changed in passport.
