amir Posted May 20, 2015 Report Posted May 20, 2015 I drove from San Diego to Tijuana,Mexico for my Visa and i got my visa (on may 14th 2015) but i did not get Visa stamped on my passport while crossing border I came to notice that when i reach back home to usa .Can you please provide some insight on my situation.

You got your visa and visa was not stamped on passport? What do you mean?
amir Posted May 20, 2015 Author Report Posted May 20, 2015 That's correct ,I got the Visa but did not get Visa stamped at post of entry and also do not have 1-94 form .
amir Posted May 20, 2015 Author Report Posted May 20, 2015 I went to TJ for my H1 Visa did all the 3day VISA process (ASC, Interview,passport pickup;got VISA) on the 4th day i cross the border from TJ into San Diego while crossing the border petrol officer did not put any stamp or any entry he was more concerned about illegal substance in car and my visa status even I forgot to check 1-94 and stamp when he gave passport back to me I 'm not sure what my situation is? I'm I in trouble ? I have checked the I-94 form site multiple times doesn't give me 1-94 it says "Not Found"

You need to exit US and specifically ask immigration officer at POE for a new I94.
USADreams Posted May 20, 2015 Report Posted May 20, 2015 Your post is very confusing . I-94 and Visa Stamp are two different things . You don't have an H1 stamp in passport ? Or you don't have an arrival stamp ?
ad2010 Posted May 21, 2015 Report Posted May 21, 2015 Land border DO NOT issue automated I-94. They issue only PAPER I94. Did you receive a new I-94 attached(valid till H1B petition expiry date) in the I-797 approval notice of ur current H1B petition? If yes, the CBP officer might have revalidated it. This happens sometimes in the land borders. If you have the valid I94, you are good and you have to return it back to airlines when you leave the country. To be safe you can consult an attorney of your choice or talk to the company attorney who filed your H1B.

amir Posted May 23, 2015 Author Report Posted May 23, 2015 I was not aware that I need to ask for new 1-94 and pay $6 for it ,so at POE they did not issued a new one and havent put a entry date stamp on passport they just let me know looking at passport and 1-797. Not having a new 1-94 on passport is an issue?I have plans to travel to india for a vacation,do i get into trouble while coming back to USA ?
Kishore Kumar Posted June 1, 2015 Report Posted June 1, 2015 POE stopped giving I-94 while entering to u.s. They'll give you a doc which says how / where to download I-94 from. I recently had a trip to India. As far as I know when you go to stamping : they attach a H1 visa copy on your passport. When u exit the country and come back in @ POE they only Stamp date of entry and write visa validity. So FOLKS am thinking VO forgot to put the stamp while entering to u.s not the VISA copy on passport. If I-94 is missing it can be / have to be downloaded from USCIS site : https://i94.cbp.dhs.gov/I94/request.html

Otherwise you are accruing illegal stay.
