She is now with new employer B on H1B visa and is going through PERM process with employer B. My question 1) Can I use her I140 from employer A for filing for H4 EAD? The thing is her previous employer revoked her I-140 ....Is it still valid for me to apply using her priority date to file for my EAD or is it Mandatory to have an Valid I-140 for me to apply for H4 EAD? rahul412 Posted May 18, 2015 Report Posted May 18, 2015 If its revoked then you cannot get H4 EAD. Does your wife has H1 ext beyond 6 yrs?
