H4 to F1 COS still pending

Hi,

 

I applied for COS H4 to F1 in Feb' 2015. The status is still pending with USCIS. Presently i am enrolled in summer course work and will be graduating in December' 2015.

 

My questions are

a.) How long does it take to get the approval from USCIS regarding COS?

b.) Eligibility for OPT needs me to be on F-1 status for 2 semesters (9 credits in each semester). As my summer course work already started, will i be eligible for OPT after my fall course work?

c.) If i won't be eligible for OPT, is anyway i can leave the country and get stamping (F-1 Visa) done in present semester?

Is it safer to go India for stamping?

 

If visa gets rejected can i come back on H-4?

Every US consulate is safe if you have all required documents.

If F1 visa application is denied you can enter with a valid H4 visa and a copy of your spouse's I797.

My H4 to F1 COS has been pending since December 12th (receipt date December 12th).

 

I created a service request on May 12th, and got an e-mail saying "The case is within normal processing time". Called the customer care and they told me if I don't hear back until June 19th then I get to create a second service request. My internship starts June 5th, so I may lose the offer if I don't get the 797 by June 3rd.

 

If you check the processing times on their website for Vermont, it says 2.5 months 

 

I think you're better off getting a stamping from India (which I regret not doing)

Thanks for the update.

 

As, I am midway in my coursework opted for F1 stamping in India.

 

My university does not require TOEFL/IELTS for getting the admit. They provide english courses based upon ESL test program.

I was offered an english grammar course which i did in my first semester.

 

As i am planning for stamping in India, will the visa officer ask my TOEFL/IELTS score card which i don't have?

If so, what should be my answer to him?

 

Please guide.

A university or school that does not ask a basic TOEFL/GRE score is mostly a shady institution. You are going for a visa interview at your own risk. The answer has to be truth as you cannot provide a test score since you do not have it.
